Scope of Online Privacy Policy

The Company owns the website located at www.exit5auto.com (the "Site"). The following Company Privacy Policy ("Privacy Policy") covers our practices with respect to the use, storage and sharing of the information we may collect from you when you: (a) visit the Site; (b) interact with any e-mail messages, other online advertising ("Company Creative") distributed by The Company and its third party marketing partners ("Third Party Marketing Partners"); and/or (c) register for any of the promotional contests and/or sweepstakes offered by The Company from time to time (collectively, the "Promotions"). The following Privacy Policy ("Privacy Policy") also covers our practices with respect to the use, storage and sharing of the information gathered from our clients when you respond to their offline advertising offers. The information we collect is shared with our affiliated entities ("Affiliated Entities"), and such Affiliated Entities shall have the same rights and obligations with respect to this information that are applicable to us as set forth herein, and subject to applicable law.

Our privacy policy adheres to the Self -Regulatory Principles for Online Behavioral Advertising. Online behavioral advertising (OBA) is defined as the collection of data from a particular computer or device regarding Web viewing behaviors over time and across non-affiliated Web sites for the purpose of using such data to predict user preferences or interests to deliver advertising to that computer, devise or person based on the preferences or interests inferred from such Web viewing behaviors.

PII that We Collect

The types of personal information we collect, and share depend on the product or service you have with us. This information can include:

  • Contact information
  • Online identifiers, including cookie identification, online account identification, and IP address
  • Transaction information
  • Social security number and income
  • Credit application information, including credit history and credit scores
  • Employment information and checking account information

We also collect your personal information from others, such as credit bureaus, affiliates, or other companies.

We need to collect and share their customers’ personal information to run our everyday business. In the following sections, we list the reasons why Exit5 Auto Group needs to collect and share their customer information, and what rights you have to limit these practices.

PII Collected by Our Marketing Partners

The Company receives PII from our Third Party Marketing Partners. PII we receive from our Marketing Partners may include: name, address, email address and information providing proof that the consumer has opted in to receive third party marketing offers. At times, we may combine PII received from our Third Party Marketing Partners with PII and Non-PII that we collect. Our use of PII collected from our Third Party Marketing Partners is limited to the uses allowed under the operative Third Party Marketing Partner's privacy policy that applies to the subject PII collection.

We reserve the right to release current or past user PII in our possession in the event we believe the user is using, or has used, our products, services and/or Site: (i) in violation of the Company terms and conditions, promotion contest rules, this Privacy Policy or any other of our operating rules, policies, price schedules and other supplemental terms and conditions or documents that may be published by us from time to time; (ii) to commit unlawful acts; (iii) if such information is subpoenaed or requested pursuant to a judicial or regulatory proceeding or inquiry; (iv) if we are sold or acquired; and/or (v) when we deem it necessary or appropriate including, without limitation, sharing e-mail addresses with other third parties for suppression purposes in compliance with the CAN-SPAM Act of 2003, as amended from time to time, and Federal Trade Commission implementing regulations.

Non-Personally Identifiable Information that We Collect

Non-personally identifiable information ("Non-PII") is information collected by The Company that does not reveal your specific identity. This Non-PII records activity either on the Site, the website of one of our Third Party Marketing Partners or in connection with Creative. Types of Non-PII that we collect include, without limitation: browser type, referring/exit pages, operating system, date/time stamp, click stream data and email open status data.

Use of Cookies and Tracking Technology

Our web servers may place and read "cookies" on your web browser when you visit our Site, access the Creative or visit the website(s) of our Third Party Marketing Partners. Cookies are small data files that are stored on an Internet user's web browser. One important use of cookies is to help identify you while you are logged in to the Site or the website of one of our Third Party Marketing Partners. Consequently, if your browser does not accept session cookies, you may be unable use the services made available on the Site. You will, however, be able to browse our Site as a visitor if your cookies are disabled. We, along with our Third Party Marketing Partners, also employ cookies and/or small pieces of code known as "web beacons" or "clear gifs" that may be incorporated into the Creative (collectively, "Tracking Technology"). As further detailed below, the Tracking Technology can be used to, among other things, count the number of users that have visited a certain web page or accessed a certain piece of The Company Creative or third party creative.

How We Use Collected Data

We may provide the data we have collected and received from third parties to any third party and we may work with other businesses to bring selected retail opportunities to our users. These businesses and third parties may include, but are not limited to: (a) providers of direct marketing services and applications, including lookup and reference, data enhancement, suppression and validation; (b) e-mail marketers (where we collect your e-mail address); (c) telemarketers (where we collect your telephone number and where permitted by applicable law); (d) SMS text-based marketers (where we receive your mobile telephone number and where permitted by applicable law); and (e) direct marketers.

We may also employ other companies and individuals to perform certain functions on our behalf. Examples include sending direct and electronic mail, removing duplicate information from user lists, analyzing data and providing marketing analysis. The agents performing these limited functions on our behalf shall have access to the data we have collected and received as needed to perform their functions for us, but we do not permit them to use your PII for other purposes.

We will also use your PII for customer service, to provide you with information that you may request, to customize your experience on the Site, and/or to contact you when necessary in connection with Promotion(s) and other transactions entered into by you on the Site, via Creative or otherwise. Who May This Dealership Disclose PII To?

Behavioral Targeting/Uses of Data and Tracking Technology

The Company reserves the right to share, rent, sell distribute and/or use Non-PII data for any and all lawful purposes. Without limiting the foregoing, The Company reserves the right to utilize Non-PII to develop and deliver our products and services, develop and deliver the products and services of our Third Party Marketing Partners, and to fulfill legal and regulatory requirements.

We use Tracking Technology to help us better manage content on the Site, and the websites of our Third Party Marketing Partners, and to determine which marketing material is effective and preferred by our respective users and customers. Without limiting the foregoing, we use Tracking Technology in our email-based Creative to inform us of which email messages have been opened by recipients so that we may gauge the effectiveness of the applicable email-based Creative. In addition, we and our Third Party Marketing Partners may use Tracking Technology to track your Internet-related activities for the purpose of providing you with tailored advertisements that match your demonstrated areas of interest.

Security

We endeavor to safeguard and protect our users' information. The privacy of your PII is very important to us. The servers that we store PII on are kept in a secure physical environment. We have security measures in place to protect the loss, misuse and alteration of PII under our control. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your PII, we cannot ensure or warrant the security of any PII that you transmit to us, and you do so at your own risk.

However, access to your PII is strictly limited, and not accessible to the public. All of our users' PII is restricted. We do not knowingly collect or receive PII or other data from minors. We encourage parents and guardians to spend time online with their children and to participate and monitor the interactive activities of their children.

Your Rights

Federal Law allows you to limit only information (1) that is shared with our affiliated companies for everyday business purposes about your creditworthiness or (2) for affiliated or non-affiliated companies to market to you. However, as of January 1, 2020 California residents have the following additional rights under the California Consumer Privacy Act to delete or limit such information. For instance:

  • You have the right to request information about: (1) the categories and pieces of personal information we have collected about you; (2) where this personal information is collected from; (3) our purpose(s) for collecting such information; and (4) the categories of third parties with whom we share such personal information.
  • You have the right to request information about our disclosure for business purposes of your personal information to third parties.
  • You have the right to request the deletion of your personal information to the extent that California law does not otherwise allow us to retain it.
  • You have the right not to be discriminated against for exercising any of these rights.

As our customer, you also have the right to opt-out of the use of your contact information for direct marketing.

Suppression of Your PII/Opting Out

At your request, we will inform you of what PII we have on file for you. In addition, at your request, we will make unavailable for future use by us any PII that you have provided to us, or that we have collected. You may contact us via e-mail at [email protected]. Please provide us with your name, street address, email address and the nature of your request. Please be advised that opting-out of receipt of communications from us will only change or delete the data contained in our database for purposes of transacting future business on the website and for managing future online communications from us. These opt-out requests will not change or delete PII which may have already been shared with third parties, all as provided above in this Privacy Policy. You will need to contact the third parties that contact you directly to change your preferences regarding their use of your PII.

We provide users with the option to opt-out from receiving information sent via electronic mailings on behalf of third party advertisers. Users may unsubscribe from receiving e-mail at any time by following the instructions contained at the beginning or end of a subject e-mail. Unsubscribe requests can only be processed if you have registered with us in an opt-out process by providing your name, address and email address. If you have not registered with us and wish to opt out of receiving e-mail from a particular sender, please review that sender's opt out policy or contact that sender.

Information sent via e-mail is prepared several days in advance. As such, users may continue to receive e-mail from us for up to ten (10) days following the unsubscribe procedures detailed above.
